Per references (a) and (b), effective 1 January 2018, a new Guam law raised the minimum age to purchase, possess, or use tobacco products, electronic smoking devices, and smokeless tobacco, from 18 to 21 years of age. In addition, this law prohibits the sale or distribution of tobacco products to persons under 21 years of age. Under this law, any person under 21, who, thereafter, purchases, possesses, or uses tobacco products, or attempts to purchase tobacco products using false identification, within the jurisdiction of Guam is subject to civil penalties by Guam. Also under this law, any person who sells or distributes a tobacco product to a person under 21 is subject to various penalties, to include monetary fines ranging from $1,000 to $10,000. 2. Compliance with Guam's new tobacco law is consistent with Department of Defense (DoD) policy as outlined in references (c) and (d), to include supporting DoD integration of the seven targeted priorities in reference (e), specifically tobacco-free living. 3. Although state laws generally do not regulate federal activities, as a matter of policy, all military and civilian personnel, dependents, family members, residents, and guests on Joint Region Marianas installations and facilities located on or at places subject to concurrent jurisdiction in the Territory of Guam, shall comply with the revised age limitations associated with the purchase, possession, use, and distribution prohibitions of Guam's new tobacco law. 4. Further, I am directing, as a matter of policy and in accordance with reference (f), that all shore-based retail sales activities located on or at places subject to concurrent jurisdiction in the Territory of Guam that is Department of the Navy (DON)-owned or controlled real property, cease selling tobacco products, including smokeless tobacco and electronic smoking devices, effective 1 January 2018, to anyone under the age of 21. In accordance with the authorities provided to the DON as the supporting component to Joint Region Marianas to regulate commissaries, exchanges, and Morale, Welfare, and Recreation MWR) activities on Joint Region Marianas installations, references (g), (h), and (i), this directive applies to, and includes, the Army and Air Force Exchange Service, Navy Exchange, and MWR non-appropriated fund instrumentalities. 5. Personnel and resale activities on areas of exclusive federal jurisdiction, including U.S. Naval vessels, are not required to comply with this minimum age restriction. 6. Joint Region Marianas, its installations, and tenant commands will disseminate this information and promote compliance. Local commanders shall disseminate the details of this policy and the change to Guam law to military personnel and their families to ensure their knowledge and understanding of the law and its implications. Local commanders will also provide information on this policy and the new law to their civilian workforce. Attention should be given to educating transient and temporarily assigned personnel, including visiting aircraft and ship crews. 7. Tobacco cessation programs in the form of counseling and medications are available to military members and beneficiaries at military treatment facilities and branch health clinics. Additionally, the DoD Quit Tobacco program encourages and promotes tobacco-free living, and can be found at the following website address - www.ucanquit2.org. Civilian employees are encouraged to seek out tobacco cessation programs, such as any offered under their applicable Federal health care benefits plan. 8. Released by the Honorable Richard V.
