REF B IS UNITED STATES NAVY REGULATIONS 1990. REF C IS SECRETARY OF DEFENSE MEMORANDUM DIRECTING A DOD-WIDE STAND- DOWN TO ADDRESS EXTREMISM IN THE RANKS. RMKS/1. Extremist conduct is contrary to good order and discipline, and erodes the faith and trust of American citizens and those Sailors, Marines, and civilian personnel affected by it. The Department of Navy (DON) has zero tolerance for extremist conduct. 2. Reference (a) prohibits Service Members from actively participating in supremacist, extremist, or criminal gang activities, ideology, or causes. Reference (b) prohibits any member of the naval service from participating in any organization advocating supremacist causes, advocating illegal discrimination, or advocating the use of force or violence against the U.S. government or a state government. Reference (a) identifies that commanders have the authority to employ the full range of administrative and disciplinary actions including administrative separation or appropriate criminal action, to sanction Sailors or Marines who actively participate in any supremacist, extremist, or criminal gang organizations. 3. In accordance with reference (c), commanding officers and supervisors at all levels are directed to conduct a "stand-down" with their personnel to address extremism by 6 April 2021. In the event operational requirements prohibit the conduct of the stand-down by this date, extension requests must be submitted through the first General or Flag Officer in the chain of command, via Chief of Naval Personnel/Deputy Commandant (Manpower and Reserve Affairs) and ultimately to the Assistant Secretary of the Navy (Manpower and Reserve Affairs) (ASN(M&RA)) for adjudication. 4. Along with the other core tenants of reference (a), the stand-down discussions may be tailored as appropriate, but needs to reinforce the DON core values Honor, Courage, and Commitment and provide an opportunity for commanders and supervisors to listen to the concerns, experiences, and possible solutions from our workforce to aid in eradicating extremism from the Department. However, the following topics must be included: a. The importance of our oaths of office or enlistment. As Service Members or federal civil servants, we each took an oath to support and defend the Constitution against all enemies both foreign and domestic. Accordingly, we will not tolerate actions that violate the fundamental principles of the oath we share, including actions associated with extremist or dissident ideologies. Sailors, Marines, and civilian personnel who support our mission deserve an environment free of discrimination, hate, and harassment. b. A description of actions that betray our oaths and are prohibited behaviors include, but are not limited to, the following: (1) Military personnel must not actively advocate supremacist, extremist, criminal gang doctrine, ideology, or causes that advance, encourage, or advocate illegal discrimination based on race, creed, color, sex (including gender identity or sexual orientation), religion, ethnicity, or national origin or those that advance, encourage, or advocate the use of force, violence, or criminal activity or otherwise advance efforts to deprive individuals of their civil rights. (2) Military personnel must not actively participate in organizations that advocate doctrine, ideology, or causes that attempt to create illegal discrimination based on race, creed, color, sex (including gender identity or sexual orientation), religion, ethnicity, or national origin, or advocate the use of force, violence, or criminal activity in furtherance thereof. Active participation includes (but is not limited to): fundraising; demonstrating or rallying; recruiting, training, organizing, or leading members; distributing material (including posting on-line); knowingly wearing gang colors or clothing; having tattoos or body markings associated with such gangs or organizations; and any other activity that furthers the objectives of these organizations that are detrimental to good order, discipline, or mission accomplishment or are incompatible with military service. (3) Military personnel are prohibited from participating in off-base demonstrations if: they are on-duty; they are in a foreign country; the activities constitute a breach of law and order; violence is likely to result; they are in uniform in violation of Department of Defense or Service regulation; or the location has been placed off-limits by a commander. (4) While not subject to military law, DON civilians must refrain from speech that qualifies as true threats, speech that incites imminent lawless action or immediate breach of the peace, or otherwise violates DON Equal Employment Opportunity policy. c. It is the responsibility of leaders at all levels to maintain an environment free of extremism and to establish procedures for reporting suspected, or actual, extremist behaviors. Reference (b) requires anyone who experiences or witnesses misconduct to report it. Reports may be made to the chain of command, the Inspector General, the Naval Criminal Investigative Service, and in accordance with specific Service policy. 5. The Chief of Naval Operations and the Commandant of the Marine Corps shall report the status of their Services' stand-down to ASN (M&RA) not later than 6 April 2021. 6. Subject to personnel resources, commanders and other leaders should consider having legal counsel present or available when conducting the stand- down required by reference (c). 7.
