MISSION
 
PRIMARY:  Manage the centralized administration and oversight of Navy and Marine Corps personnel placed on involuntary appellate leave pending the outcome of appellate review of court-martial convictions resulting in punitive discharges.
 
SECONDARY:  Track Navy & Marine Corps members on Mandatory Supervised Release (MSR) and Parole that are pending appellate review.
 
  • NAMALA DOES NOT track members in confinement.
  • NAMALA DOES NOT track members on Voluntary Appellate Leave, Admin Separation Leave, or members in receipt of an other than honorable characterization of service.
  • NAMALA DOES NOT provide legal advice or case updates to appellants. For legal inquiries or case information, members should contact their assigned appellate defense counsel.

VOLUNTARY APPELLATE LEAVE
 
Members may request voluntary appellate leave any time after their court-martial conviction (after serving confinement, if applicable) but before the EOJ date. While on voluntary appellate leave, members remain attached to their current command. Once the EOJ is signed, members receive a status transfer notification, converting voluntary appellate leave to involuntary appellate leave. Only then are members transferred to NAMALA. Commands should use NPPSC Form 5800/2 (voluntary tab) checklist.
 

INVOLUNTARY APPELLATE LEAVE
 
Members are placed on involuntary appellate leave and transferred to NAMALA after all confinement time has been served (if applicable), the EOJ has been signed/completed, and the appellate review is still pending.  If confinement was not awarded, the member is placed directly on involuntary appellate leave on or after the date of the EOJ and transferred to NAMALA.
 
Upon receipt of the EOJ, the following should occur:
 
    1.  If the member is still attached to the command, but on voluntary appellate leave (applies to members not awarded confinement - or - members released from confinement prior to the EOJ being completed), the command shall contact NAMALA (omb_mbw_namala@usmc.mil) to verify whether the member’s appellate review is still pending.
 
         a.  If the appellate review has not been completed, the command will utilize NPPSC Form 5800/2 (involuntary tab) to place the member on involuntary appellate leave while simultaneously coordinating with NAMALA staff to administratively transfer the member by service record.
 
          b.  If the appellate review has been completed, the command is required to execute the member’s discharge from service.
 
    2.  If the member is still in confinement, complete the process listed in paragraph 1 upon release from confinement.
